2.DEFINITIONS

3.6 All your credentials are stored in the database of the company and will not be passed on to third parties unless in accordance with the terms set out in the Privacy Policy Section. In case of suspected offences concerning games or prize manipulation, the AGITS reserves the right to share the suspected offender’s details with lottery bodies, authorities, or other relevant third parties.

4.LEGAL USE OF THE WEBSITE ITS COMPONENTS AND ALL MEDIA COLLATERAL
4.1. You may not alter, modify, copy, distribute (for compensation or otherwise), transmit, display, perform, reproduce, reuse, post, publish, license, frame, download, store for subsequent use, create derivative works from, transfer, or sell any Content without the express written consent of AGITS.
4.3. By using this Website, the User authorizes AGITS to use the name, town/city of residence and/or the image of the User for publicity or AGITS’s own promotional material. In the event of a significant win (a sum not less than NGN 50,000.00) in any of the Lottery games, AGITS may contact the User to request such material. Please note that funds may be temporarily withheld until the requested material has been received. AGITS would always make every “reasonable attempt” to contact the User before using/requesting such material (reasonable attempt is defined as three attempted contact attempts by telephone, e-mail, or text message).
4.4. By participating in our products and assets, including social media campaigns and promotions, the User expressly grants AGITS the rights to all media (images, voice, videos etc.) and content submissions and authorizes AGITS to unlimited perpetual reuse of said material for AGITS’s own promotional purposes.
4.5. We reserve the right, at our sole discretion and at any time to take the following actions:
(i) deny any account creation request,
(ii) terminate your account and subscription to the Website, either in whole or part.
(iii) remove any Lottery Game from the Website.
(iv) to modify, interrupt, limit, suspend or discontinue, temporarily or permanently, the Website, any subscription or access to the Website or any Lottery Game available through the Website. 6.CONDITIONS OF USE

7.PLAYER ACCOUNT
7.1. To register and open a Player’s Account, you are required to provide the following basic player information:

7.2. By submitting information to register for a Player’s Account, initiating a deposit or payment or updating your existing account profile, you represent and warrant that:

7.9. You have the right to request the closure of your Account at any time by submitting a written request to customer service.

8.LOTTERY GAMES AND HOW TO PLAY
8.1. How To Play

9.DRAWS

9.4. Consolation prizes are not automatic, but as specified in the games description at the time of entering

10.PAYMENT OPTIONS
10.1. Verification Checks: When you perform any transaction, AGITS may conduct necessary verification checks, as required by us or third parties (including regulatory bodies), to confirm legal ownership, the origin of funds, applicant identity, and compliance with relevant Anti-Money Laundering Provisions.
10.2. Funds Held as Trustee: AGITS holds the funds deposited in the Player’s Account as a trustee for the User, not as a banker or debtor. As such, there is no obligation for AGITS to repay money to the User as a debtor.
10.3. Increasing Play Wallet Credit: Users have the option to increase the credit balance of their wallet using the payment methods made available by AGITS, such as credit/debit card, bank transfer, or virtual card (only for deposits).
10.4. Purchase Cancellation and Responsibility: Once a purchase is completed, it cannot be cancelled. You are solely responsible for ensuring the accuracy of your selection, including the correct lottery game, the number of plays, the price of plays, and the numbers played on any tickets or shares. Purchases made in error will not be refunded. We shall not be liable for any losses resulting from any errors made in your purchase selection.
10.5. If any funds are mistakenly credited into your wallet by AGITS, we are entitled to make the appropriate adjustments. You must notify us of the errors immediately and no more than seven days following the transaction in question. If you transfer funds incorrectly credited to your account, we may withhold that amount from any deposit or winnings or seek recovery. If you use any funds incorrectly credited to your account to purchase a lottery ticket, we may deem the purchase void and refuse to pay any prize or recover any prize.
10.6. In the event that any funds are mistakenly deducted from your wallet, we are entitled to make the appropriate adjustments. If any funds are incorrectly deducted from your wallet, you must notify us of the errors immediately and not more than 30 days following the transaction in question.
17.APPLICABLE LAW
17.1. Any lottery placed by the User shall be governed by the applicable provisions of the Osun State Lottery Regulations, and any Regulations and Rules made in terms thereof, as amended from time to time. The User is responsible for ensuring they are aware of these provisions.
17.2. These Terms and Conditions, as well as any other legal relationship, dispute, and claims between the User and AGITS, are subject to Nigerian laws.
17.3. If the User plays a Lottery Game from a location outside Nigeria, such Lottery Game shall be subject to all appropriate exchange control regulations and the laws of the foreign jurisdiction from which such communication originates. It is the User’s responsibility to ensure full compliance with these regulations. AGITS makes no warranties and shall not be liable to the User if it is unable to remit any monies held by it to any account held by the User in a foreign jurisdiction.
17.4. Any legal suit, action, or proceeding arising out of or related to these Terms of Use or the Website shall be instituted exclusively in the federal courts of Nigeria. You waive any and all objections to the exercise of jurisdiction over you by such courts and to the venue of such courts.
17.5.ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE WEBSITE MUST BE COMMENCED WITHIN STATUTE OF LIMITATION OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
18.DISPUTE RESOLUTION
18.1. At the Company’s sole discretion, it may require you to submit any disputes arising out of or relating to these Terms of Use or the Website, including disputes concerning their interpretation, violation, invalidity, non-performance, or termination, to the Osun State Chamber of Commerce International Arbitration Centre (IAC Arbitration Rules), which Rules are deemed to be incorporated by reference into this Clause.
18.2. By accepting these Terms of Use, you agree that any claim you may have is subject to resolution exclusively by such arbitration in such a case.
18.3. The arbitration will be conducted in the English language, which is the ruling language of this T&C.

19.REFUND POLICY
